On Thursday, February 14th, the Living Donor Protection Act (H.R. 1224/S. 511) was introduced by Representative Jerrold Nadler (D-NY) and Representative Jaime Herrera Beutler (R-WA), Senator Kirsten Gillibrand (D-NY), and Senator Tom Cotton (R-AR).
This act will protect living organ donors and remove barriers to donation by prohibiting insurance companies from denying or limiting life, disability and long-term care insurance to donors, and from charging higher premiums. Through changes to the Family and Medical Leave Act (FMLA), it also codifies into law job security for living organ donors while recovering from donation.
The wait list for a kidney transplant is long and many individuals will die before ever receiving a kidney. There are nearly 100,000 people on the wait list Living donors make a substantial contribution to increasing the number of transplants each year. In 2018, one-third of kidney transplants were made possible by living donors. We must act to ensure living donors are protected and that barriers such as fear of job loss and limitations by insurance companies are removed.
